Housing Lawyer

Morgan Hunt are currently working with a Housing Association in their search for a permanent Housing Lawyer (Solicitor/Legal Executive) to provide timely advice on all aspects of Housing Law and Civil litigation across the Group

As part of the Legal Services team, you will deal with all aspects of contentious housing management including possession, disrepair, anti-social behaviour and other tenancy and housing management issues.

You will effectively monitor and manage caseloads, maintain legal case files, draft legal documentation including small claims and fast track county court applications. You will also be an advocate and represent the Group at County Courts.

The successful candidate will be a Qualified Solicitor or Fellow of Chartered Institute of Legal Executives (CILEX) with demonstrable experience in Housing Litigation. You will have knowledge of all areas of Housing legislation, with signification experience of working in Housing management litigation including, civil litigation, Housing Law, anti-social behaviour, Injunctions, and possession proceedings. You will be an experienced Advocate in County Court, and hold Rights of Audience qualification.

This is an exciting opportunity to join and expanding team, to which you will be provided strong development opportunities to widen your legal experience. You will be required to travel to Group offices across Staffordshire and Shropshire, as and when required. There is no billing or charging time pressure.

Job Title: Housing Lawyer (Solicitor/Legal Executive)

Location: Hybrid (2 days per week in Stafford)

Hourly Rate: £42,000 - £45,000

Job Type: Permanent

Hours: Full-Time (37 hours per week)

Key Responsibilities

  • Provide client focussed timely advice on all aspects of Housing Law and Civil litigation
  • Provide support to the in-house Legal Services Team (including admin support and engaging with the team on projects or cases)
  • Provide day-to-day legal advice to department officers across the group
  • Carry out effective case management of litigation files relating to civil, housing, Anti-Social behaviour, and disrepair cases, assessing quantum and drafting documentation ancillary to pending and or ongoing proceedings including without prejudice offers, defence and settlement of claims where appropriate
  • Maintain live legal case files, and drafting legal documentation, relating to disrepair and civil litigation claims, small claims and fast track county court application
  • Ensure case conduct processes for defending litigation claims brought against the organisation are fully compliant with relevant Civil Procedure Rules (CPR), and all legislative and statutory requirements and protocols
  • Assist in drafting documents in preparation for application in relation to injunctions, possession proceedings cases
  • To represent the Group at County Courts and to be an advocate for the Group

Person Specification

  • Qualified Solicitor, Fellow of Chartered Institute of Legal Executives (CILEX) with demonstrable experience in Housing Litigation
  • Rights of Audience (Civil) Qualification
  • Significant current and demonstrable experience of working in Housing management litigation including, civil litigation, Housing Law, anti-social behaviour, Injunctions, and possession proceeding
  • Knowledge and experience of all areas of Housing legislation, the Pre-Action Protocol and Housing Conditions Claims, England
  • Experienced advocate in County Court
  • Current working knowledge and experience of all aspects of UK legislation affecting the housing sector e.g. Housing Act 1988, 1996, Anti-Social behaviour Crime and Policing 2014, Act, the Homes (Fitness for Human Habitation)Act 2018,Defective Premises Act
  • Knowledge of all related Statutory and Contractual issues, including alternatives to litigation ADR Mediation, Pt 36 assessments
  • Good working knowledge of the Civil Procedure rules and protocols relating to disrepair
  • Excellent legal drafting skills on all types of Court documentation / Witness statements / Appeals / instructions to Counsel
  • Strong knowledge of all legislative technical matters, which impact upon applicable Housing legislation
