Our well established client is seeking an experienced Family Solicitor to join their busy family department between March and May next year in their Lancashire office. The firm is seeking a specialist family solicitor 5 years PQE to work with the Managing Partner and Head of Family department. You will inherit an ongoing good quality full caseload of mostly finances on divorce/separation and some private law Children Act work. You are preferably already a /Resolution Accredited specialist in Finances on Divorce and Private Law Children work. The Head of Family and the retiring partner enjoy a very longstanding good reputation and benefit from repeat clients and recommendations. They do not undertake publicly funded work and have not done so for over 20years. You will be commercially aware as to billing/recovery/targets and used to working to deadlines and targets. Also able and willing to engage in marketing events and requirements organised by the Business Development Manager. They do not have a formal WFH policy and the role is office based although being able to WFH on occasion is not an issue. You will be Experienced in: Finances on Divorce/Separation including: 1) Part 25 procedures re mostly Pension, Forensic Accountant, surveyor instruction; 2) PAG; 3) Maintenance pending Suit/interim maintenance; 4) S 31 variation applications; 5) (or knowledge of) Legal Costs Orders under S22ZA 6) Disclosure requirements under pre application protocol; 7) Finances on divorce proceedings; 8) Divorce procedure; 9) Advocacy at FDA (if required), FDR's, interim applications; 10) Briefing Counsel, attending conferences; 11) Procedure on urinterlocutory applications; 12) Court bundles under Part 27A 13) Or knowledge of S37 financial injunctions 14) Drafting pleadings including directions/Final Orders, ES1,ES2, statements of issues, case summaries/position statements, skeleton arguments, Witness statements of truth/affidavits; 15) Drafting Pre-Nup's and Post Nup Agreements Sch 1 Children Act 1. Experience of making applications, procedure an advantage Separation: 1. Disclosure requirements; 2. Separation Agreements; 3. Living Together Agreements; 4. TOLATA experience an advantage; Private Law Children Act 1. Procedure and pre application requirements/negotiation; 2. Knowledge of welfare checklists and current caselaw; 3. Advocacy at FHDRA, DRA; 4. Making and defending internal and external child relocation applications; 5. Advocay at more straightforard final hearings an advantage; 6. Drafting interim directions and final Orders; 7. Drafting case summaries, position statmements, witness statements 8. Briefing Counsel; 9. Experts directions re. blood, hairstrand testing etc, 10. Familiar with CAFCASS requirements and reporting; 11. Urgent applications inclusing spend time with, live with, specific issue/prohibited steps 12. Court bundles per Part 27A Family Law Act Injunctions: 1. Making and defending non-mol, occupation Orders incl assessing when an emergency; 2. Procedures; 3. Drafting applications, Orders, Undertakings 4. Advocacy on interim applications 5. Advocacy on final hearings an advantage 6.
